Derek Smith, seen here in a surveillance image, was arrested on assault charges.

A 56-year-old man was arrested and charged with assault in the third degree for beating a woman on a northbound N train in the Bensonhurst area during the morning rush hour.

Police say that on Thursday, November 16 at around 7:40 a.m., the victim, 37-year-old Sam Saia, sat down on the train next to the alleged perp, Derek Smith. After a verbal argument occurred regarding seating space, with the victim complaining that her neighbor was “manspreading,” the man responded by cursing at her and punching her in the face several times.

“A bunch of good people ran to help me, as my lip was gushing blood,” Saia wrote on her Facebook page. “A good Samaritan then intervened to stop the attack, and the alleged perp exited the train at the 18th Avenue Station.”

Smith was arrested on Saturday, November 18. The victim suffered a laceration to her lip.
